SUSAN M. CHARTERS

Susan focuses her practice on the defense of foreign litigants in federal and state courts. Her experience includes the defense of products liability, premises liability, and policy coverage disputes, as well as advising insurers in multidistrict litigations involving pharmaceutical and product manufacturers. Susan has also developed a keen focus on terrorism-related litigation and frequently advises on the interpretation and application of federal anti-terrorism financing statutes.

Anti-Terrorism Financing Cases – Advises on high-profile litigations filed against insured foreign banks under the Anti-Terrorism Act (“ATA”) and related federal anti-terrorism financing statutes.

NCS Power, Inc. v. Yoku Energy Technology Ltd. – Represents Chinese manufacturer in defense of action arising out of product liability claims in the United States District Court for the Southern District of New York.

Smith & Nephew v. New Hampshire Insurance Company, et al. – Represents New Hampshire Insurance Company in coverage litigation brought by medical device manufacturer pending in the United States District Court for the Western District of Tennessee regarding insurance coverage issues on excess policies written and issued in London, England.

Bondo v. Well Done-Eliat, Ltd – Represents Israeli household product manufacturer in products liability action in New York.

DES Litigation – Represents drug manufacturer in defense of numerous products liability actions in the United States District Court for the Eastern District of New York involving "in utero" exposure to prescription medication diethylstilbestrol (“DES”).

AIS Cases - Monitors consolidated litigation filed on behalf of over 250 plaintiffs regarding statutory and regulatory requirements of Immigrant Investor Program filed in United States District Court for the Central District of California.

In Re: Bisphenol-A (BPA) Polycarbonate Plastic Products Liability Litigation – Monitored products liability litigation involving the chemical bisphenol-A in the United States District Court for the Western District of Missouri on behalf of insurer.

In Re: Prempro Products Liability Litigation (MDL) – Monitored hormone replacement products liability litigation in United States District Court for the Eastern District of Arkansas on behalf of insurer.

In Re: Gadolinium-Based Contrast Agents Products Liability Litigation (MDL) – Monitored products liability litigation involving injectable dye used for magnetic resonance imaging in United States District Court for the Northern District of Ohio.

Kurth v. Arcelormittal, USA, Inc. – Monitored class action involving claims for toxic air emissions under nuisance statute in the United States District Court for the Northern District of Indiana.

Guam Power Authority v. National Union – Represented National Union in insurance coverage arbitration in New York regarding Time Element Pollution Endorsement on policy written and issued in Guam.

Mahler v. Zhehiang Wanda Export, Co. – Represented Chinese manufacturer in products liability litigation in New York.

Ulto v. Hilton Corp. - Represented Hilton in premises liability litigation in New York brought by guest of its hotel in Tel Aviv, Israel.

Deschamps v. Starwood – Represented Starwood in premises liability litigation in New York brought by a guest of its hotel in Aruba.

Various Plaintiffs v. Castrol Industrial North America – Monitored products liability litigation filed in multiple state and federal courts alleging bodily injuries as a result of exposure to benzene on behalf of insurer.

Van Praagh v. Hilton – Represented Hilton in litigation arising out of injuries allegedly sustained as result of slip and fall at hotel in London.

Rudinsky v. Hilton – Represented Hilton in premises liability action instituted by guest of at hotel in Dominican Republic.
